The Supreme Court of Pakistan (SCP) has rejected the Sindh government’s petitions concerning the quota for deceased government employees and has upheld the Sindh High Court’s ruling.
According to details surfaced on Friday, in its verdict, the SC maintained the decision of the Sindh High Court, which had directed the appointment of the legal heirs of deceased government employees under the relevant quota. The judgment, authored by Justice Muhammad Ali Mazhar, said that cases which have already been decided cannot be reopened.
It held that there was no legal defect in the orders of the Sindh High Court and that decisions relating to the quota for deceased employees had attained finality. The court further held that decisions striking down laws cannot be applied retrospectively. It clarified that the ruling in the General Post Office case would not apply to cases that had already been disposed of.
Judicial decisions, the court observed, apply prospectively unless their retrospective application is expressly stated. The SHC had, between 2019 and 2023, issued orders for the appointment of heirs under the deceased employees’ quota.
